Yes, the homebuyers /allottees can claim compensation higher than that mentioned in the Buyers Agreement where the compensation provided under the Agreement is meagre and the terms of the Agreement are unfair and skewed in favour of the Builder. Thus, if the builder is causing a gross delay in handing over possession, beyond the period which has been agreed, then the consumer forum will be justified in granting compensation beyond the terms of rate mentioned in Buyers Agreement. *[Refer R.V.
